Cash Medical and Health Insurance


LAWS REGARDING HEALTH INSURANCE AND MEDICAL SUPPORT CHANGED IN 2008 AND 2019.

OCSS is required by federal law to:
  • Identify who is ordered to carry insurance and/or pay cash medical support.
  • Verify health insurance enrollment by the party ordered to carry coverage.
  • Enforce medical support orders.

Since September 2008, all new or modified orders must address medical support and include:
  • The name of the party or parties responsible for carrying health insurance.
  • A cash medical support amount to be paid in addition to the child support amount ordered.

For child support orders established or last modified before March 28, 2019
  • Cash medical support is only charged when insurance coverage is not being provided.
  • If neither parent has access to reasonable cost insurance coverage, both parties are required to notify OCSS if it becomes available to them.

For orders established or last modified on or after March 28, 2019

Cash medical support will always be charged.

The custodial parent will be ordered to provide health insurance unless:
  • The non-custodial parent already has reasonable cost coverage or has access to it
  • The non-custodial parent has coverage in place, even if not reasonable in cost, and elects to provide coverage
  • The custodial parent is a caretaker or agency

If neither parent has access to reasonable cost coverage, the custodial parent will be ordered to obtain it within 30 days of it becoming available to him/her.
